DMCA Copyright Policy
Royall Labs, Inc. ("Royall") respects the intellectual property rights of others and expects its users to do the same. Royall is a registered service provider with the United States Copyright Office under the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"). This page describes how to send Royall a DMCA notice of claimed infringement, how alleged infringers can respond, and Royall's policy on repeat infringers. The contact details for Royall's Designated Agent are listed at the bottom of this page (or in the public directory at dmca.copyright.gov).
1. Submitting a Notice of Claimed Infringement
To file a DMCA notice with Royall, please send Royall's Designated Agent a written communication that contains substantially all of the following — these are the elements 17 U.S.C. § 512(c)(3) requires for a valid notice:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on the Royall service are covered by a single notification, a representative list of those works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit Royall to locate the material — for example, the URL of the page on Royall where the material appears.
- Information reasonably sufficient to permit Royall to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate, and that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Royall will act expeditiously to remove or disable access to material that is the subject of a compliant notice. Notices missing required elements may be returned to the sender for completion.
2. Counter-Notification (for users whose content was removed)
If you believe content of yours was removed or disabled by Royall as a result of a mistaken DMCA notice or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g). Send your counter-notification to Royall's Designated Agent with the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Royall may be found), and that you will accept service of process from the person who provided the original notification.
Upon receipt of a valid counter-notification, Royall will promptly forward a copy to the original complaining party. If the complaining party does not file an action seeking a court order against you within 10 to 14 business days of Royall's forwarding the counter-notification, Royall may restore the removed material under § 512(g)(2).
3. Repeat Infringer Policy
Consistent with 17 U.S.C. § 512(i)(1)(A), Royall maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright. A "repeat infringer" means a user who, after a reasonable opportunity to be heard, has been the subject of multiple, separate, valid DMCA notices of infringement that Royall has acted on.
What "appropriate circumstances" looks like in practice depends on the severity, frequency, and recency of infringing activity, as well as any rebuttal a user offers. Royall reserves the right to terminate accounts immediately when the infringing activity is severe (for example, willful uploading of biometric material the user knows belongs to someone else), and to issue warnings and demand corrective action for lesser repeat behavior. Account termination may, at Royall's discretion, include forfeiture of any pending or future payouts associated with the terminated account.
4. Material Misrepresentation
Please be aware that, under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents either (a) that material on Royall is infringing, or (b) that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, to the alleged infringer, to the copyright owner or authorized licensee, and to the service provider.
Royall reserves the right to seek recovery against parties who file abusive or knowingly false DMCA notices or counter-notifications targeting content hosted on or filed through Royall.
5. Notices via Royall's outbound Radar pipeline
This page describes the procedure for sending DMCA notices to
Royall regarding material hosted on the Royall service. Separately,
Royall offers its registered creators an in-product workflow to send
DMCA notices from Royall on their own behalf, against
unauthorized derivative material on third-party platforms (see the
Likeness Radar feature). Notices dispatched through Royall's outbound
Radar pipeline are sent from the address
dmca@royall.ai with the creator named as the rights-holder
and the creator's preferred contact as the Reply-To address. Royall
facilitates these filings; the creator is the rights-holder making the
sworn statements required by § 512(c)(3).
6. Updates
Royall may update this Policy from time to time. The current designated agent record is always available in the U.S. Copyright Office's public directory at dmca.copyright.gov under registration number DMCA-1072820.
